The PlanTheMagic Creator Partner Programme is an invite-only referral programme for approved creators based in the United Kingdom or the United States. Creator partners may receive one-off fixed commissions for eligible new PlanTheMagic customers who sign up through their creator referral link, become paid subscribers, and pass the applicable qualification period.
Creator referral tracking currently uses a creator vanity URL, internal referral code, session tracking, and browser cookies. The current attribution window is up to 90 days from a customer’s first valid click, and first valid creator referral tracking is not overwritten by later creator links. A commission becomes payable only after the referred customer pays their first subscription invoice and the 30-day qualification hold has passed without refund, chargeback, cancellation, fraud, misuse, or another disqualifying event.
Creator partners must clearly disclose their paid referral relationship where required by law or platform rules, must not misrepresent PlanTheMagic, and must not use spam, misleading incentives, protected brand bidding, fake coupons, bots, forced clicks, cookie stuffing, or other prohibited promotional methods.
PlanTheMagic may, at its discretion, provide a creator with complimentary subscription access for familiarisation and promotional purposes, but may withdraw that access at any time and for any reason.
Participation does not guarantee income, referral volume, dashboard availability, payment timing, or continued programme access.
1. About these Terms
1.1 These Creator Partner Programme Terms govern your participation in the PlanTheMagic Creator Partner Programme.
1.2 These Terms are separate from the main PlanTheMagic customer Terms of Service. You do not need to have accepted the customer Terms of Service in order to participate in the Creator Partner Programme.
1.3 By ticking the acceptance box during creator onboarding, submitting a creator profile, accessing the creator dashboard, or using a creator referral link, you agree to these Terms.
1.4 You will also be asked to accept the PlanTheMagic Privacy Policy during creator onboarding. The Privacy Policy explains how we collect, use, store, and share personal data relating to creator partners.
1.5 If you participate on behalf of a company, partnership, limited liability company, or other organisation, you confirm that you have authority to bind that organisation to these Terms. In that case, references to “you” and “Creator” mean both you personally and the organisation you represent, unless the context requires otherwise.
2. Who We Are
2.1 The Creator Partner Programme is operated by Island Ascent Limited, a private limited company registered in England and Wales under company number 17186774, trading as PlanTheMagic.
2.2 Our contact email is: contact@planthemagic.net .
2.3 Our registered office and geographical address is: Island Ascent Limited, 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.
2.4 All contracts for the Creator Partner Programme are between you and Island Ascent Limited, trading as PlanTheMagic.
3. Definitions
In these Terms:
“Creator” means an individual, company, or other approved participant in the Creator Partner Programme.
“Creator Dashboard” means the online dashboard or account area where creator programme information may be displayed.
“Creator Referral Link” means the unique creator-facing referral link issued to you, including a vanity URL such as `planthemagic.net/[creator-name]`.
“Creator Referral Code” means the internal referral code associated with your Creator Referral Link.
“Customer” means a person who creates a PlanTheMagic customer account.
“New Customer” means a genuinely new PlanTheMagic customer who has not previously held, used, deleted, duplicated, or controlled another PlanTheMagic account in circumstances that PlanTheMagic reasonably considers to be inconsistent with a genuine new referral.
“Pending Commission” means a commission that has been recorded but has not yet passed all qualification, review, and payment conditions.
“Payable Balance” means the amount shown as payable in your Creator Dashboard after applicable commissions have qualified and any adjustments, reversals, holds, deductions, or thresholds have been applied.
“Programme” means the PlanTheMagic Creator Partner Programme.
“Qualified Conversion” means an eligible New Customer referral that satisfies the requirements in these Terms.
“Promotional Content” means any post, video, story, reel, short, live stream, email, message, article, podcast, web page, link page, group post, private-community post, review, screenshot, tutorial, or other content that mentions, links to, recommends, or promotes PlanTheMagic.
“Protected Brand Terms” means “PlanTheMagic”, “Plan The Magic”, “planthemagic.net”, any misspelling or variant of those terms, and any confusingly similar wording, branding, domain, or identifier.
4. Programme Eligibility and Approval
4.1 The Programme is invite-only.
4.2 You may participate only if PlanTheMagic approves your creator profile and keeps it in good standing.
4.3 The Programme is currently available only to approved creators who are based in the United Kingdom or the United States and who have a valid UK or US bank account suitable for payout.
4.4 If you are an individual, you must be at least 18 years old.
4.5 Both individuals and companies may participate, subject to approval.
4.6 You must provide accurate, complete, and current information in your creator profile, including your name, email address, country, social handles, website, audience size, and payout details.
4.7 You must keep your creator profile and payout details up to date.
4.8 If you move outside the United Kingdom or the United States, you may continue to participate only if you continue to maintain a valid UK or US bank account and PlanTheMagic allows your creator profile to remain active.
4.9 PlanTheMagic may approve, reject, pause, restrict, or remove any creator profile at its discretion, with or without giving detailed reasons.
4.10 Participation in the Programme does not guarantee any commission, income, referrals, traffic, conversion volume, dashboard availability, payment timing, or continued access to the Programme.
5. Complimentary PlanTheMagic Subscription
5.1 PlanTheMagic may, at its sole discretion, provide you with complimentary access to a PlanTheMagic subscription so that you can become familiar with the Service and prepare accurate Promotional Content.
5.2 Complimentary access is not a commission, reward, payment, or benefit owed to you. It has no cash value, is non-transferable, and must not be sold, assigned, shared, or otherwise made available to anyone else.
5.3 You may use any complimentary subscription only for personal familiarisation, review, testing, and lawful promotion of PlanTheMagic in connection with the Programme.
5.4 Your use of any complimentary subscription is subject to these Terms and, to the extent you access or use the customer-facing PlanTheMagic service, the PlanTheMagic customer Terms of Service and Privacy Policy.
5.5 PlanTheMagic may suspend, restrict, withdraw, or end complimentary access at any time, with or without notice, for any reason. This includes, without limitation, where PlanTheMagic considers that your creator profile is inactive, underperforming, no longer in good standing, no longer aligned with the Programme, or no longer requires complimentary access.
5.6 Withdrawal of complimentary access does not automatically terminate your participation in the Programme unless PlanTheMagic tells you otherwise. It does not entitle you to compensation, refund, commission, payout, subscription credit, or any other payment.
5.7 If your participation in the Programme is suspended or terminated, PlanTheMagic may also suspend, restrict, or end any complimentary subscription linked to your creator profile.
6. Creator Dashboard
6.1 Your Creator Dashboard may show information such as clicks, signups, trial starts, pending referrals, qualified conversions, commission rate, pending balance, payable balance, and payout history.
6.2 Dashboard data is indicative only unless and until a commission is approved and paid.
6.3 PlanTheMagic may correct dashboard data retroactively where needed, including where there are tracking errors, display errors, duplicate entries, fraud, refunds, chargebacks, cancellation, misuse, customer ineligibility, or breaches of these Terms.
6.4 The Creator Dashboard may be unavailable, delayed, incomplete, or inaccurate from time to time. PlanTheMagic does not guarantee uninterrupted dashboard availability or real-time reporting.
7. Referral Tracking and Attribution
7.1 Creator referrals may be tracked using one or more of the following:
- (a) your Creator Referral Link;
- (b) your internal Creator Referral Code;
- (c) session tracking;
- (d) browser cookies; and
- (e) other technical attribution methods used by PlanTheMagic.
7.2 The creator-facing link is your vanity URL. Internally, PlanTheMagic resolves that vanity URL to your canonical Creator Referral Code and stores that code for attribution.
7.3 The current creator referral attribution window is up to 90 days from the customer’s first valid click on your Creator Referral Link.
7.4 A referral may be attributed to you only if the customer signs up while your creator referral tracking remains active.
7.5 Attribution is not guaranteed. Referral tracking may fail or be unavailable for reasons outside PlanTheMagic’s control, including cookie blocking, browser settings, user deletion of cookies, privacy tools, technical errors, invalid links, incorrect use of links, account duplication, or customer behaviour.
7.6 If a customer clicks more than one creator referral link, the first valid creator referral captured by PlanTheMagic will apply. Later creator referral links will not overwrite the first valid attribution.
7.7 A customer may be attributed to only one creator partner.
7.8 Creator referrals apply only to new PlanTheMagic account registrations that are attributed to the Creator Referral Link before or during signup.
7.9 PlanTheMagic may decline, reverse, void, or adjust commissions for duplicate accounts, returning customers, previously deleted accounts, trial re-use, suspicious activity, bot traffic, fake accounts, low-quality traffic, or accounts that PlanTheMagic reasonably determines are not genuine New Customer referrals.
7.10 Self-referrals are not treated as a separate automatic breach solely because of the relationship between the Creator and the Customer. However, PlanTheMagic may decline, reverse, void, or adjust any commission where the referral is not a genuine New Customer referral, involves an account controlled by the Creator, involves abuse, or is otherwise inconsistent with these Terms.
8. Qualified Conversions
8.1 A commission is earned only for a Qualified Conversion.
8.2 A Qualified Conversion occurs only where:
- (a) a New Customer signs up through your valid Creator Referral Link while referral tracking remains active;
- (b) the New Customer becomes a paid PlanTheMagic subscriber;
- (c) the New Customer’s first paid subscription invoice is successfully paid;
- (d) the 30-day qualification hold has passed;
- (e) no refund, chargeback, cancellation, payment failure, fraud, misuse, duplicate account, trial abuse, customer Terms breach, or other disqualifying event has occurred; and
- (f) PlanTheMagic has not otherwise declined, reversed, held, or adjusted the commission under these Terms.
8.3 The qualification hold starts on the date the referred customer’s first successful paid subscription invoice is received.
8.4 No commission is payable for a customer who cancels during the free trial.
8.5 No commission is payable for a customer who receives complimentary access, free access, beta access, manual access, internal test access, or any other non-paid access.
8.6 If a customer pays but receives a refund, including a discretionary refund shortly after trial conversion or renewal, the related commission may be voided or reversed.
8.7 If a customer renews for a later subscription period, no additional creator commission is payable. Creator commissions are one-off acquisition payments only and are not recurring revenue share.
9. Commission Rates
9.1 Creator commissions are fixed-amount commissions per Qualified Conversion.
9.2 Commission rates may differ between UK creators and US creators.
9.3 Your applicable commission rate is shown in your Creator Dashboard or otherwise communicated by PlanTheMagic.
9.4 Commission rates are not determined by customer country, subscription price, coupon use, discount use, promotional price, or creator tier unless PlanTheMagic expressly states otherwise.
9.5 PlanTheMagic may change commission rates prospectively.
9.6 Unless PlanTheMagic determines that a commission should be voided, held, reversed, or adjusted under these Terms, a commission rate change will not reduce a Pending Commission already recorded before the rate change.
9.7 PlanTheMagic may correct any commission amount that was incorrectly recorded because of an error, bug, misuse, breach, tracking error, or incorrect dashboard display.
10. Payouts
10.1 Payouts are prepared manually.
10.2 Payouts are made only when your Payable Balance reaches the applicable minimum payout threshold.
10.3 The current minimum payout thresholds are:
- (a) £25 for UK creators; and
- (b) US$50 for US creators.
10.4 UK creators are paid in GBP. US creators are paid in USD. Creators cannot choose a different payout currency.
10.5 UK creators are paid by UK bank transfer.
10.6 US creators are paid by US bank transfer or ACH using local payment networks, not SWIFT.
10.7 PlanTheMagic may prepare payouts monthly, but only where the applicable threshold has been reached and no hold, investigation, missing information, incorrect details, or disqualifying event applies.
10.8 PlanTheMagic may delay, hold, or refuse a payout where:
- (a) payout details are missing, incomplete, incorrect, or appear incorrect;
- (b) your creator profile is incomplete or under review;
- (c) your Payable Balance has not reached the applicable threshold;
- (d) PlanTheMagic is investigating suspicious activity, fraud, misuse, tracking errors, customer refunds, chargebacks, or breaches of these Terms;
- (e) PlanTheMagic reasonably needs to verify eligibility; or
- (f) payment would be unlawful, impractical, or commercially unreasonable.
10.9 PlanTheMagic will normally pay ordinary transfer fees charged by its payment method. However, you are responsible for any costs, losses, or reprocessing charges caused by incorrect, incomplete, outdated, or misleading payout details provided by you.
10.10 If a payout fails because of incorrect or incomplete payout details, PlanTheMagic may deduct reasonable reprocessing costs from your balance.
10.11 Unpaid balances may expire after 12 months of inactivity, missing payout details, or failure to meet payout requirements, where lawful.
10.12 If a commission has already been paid and later becomes invalid because of refund, chargeback, fraud, customer ineligibility, tracking error, breach, or misuse, PlanTheMagic may offset the amount against future commissions.
10.13 Where an invalid paid commission relates to your breach of these Terms, fraud, bot activity, fake accounts, forced clicks, misleading promotion, or similar misconduct, PlanTheMagic may require repayment.
10.14 You are responsible for any bank information you provide. PlanTheMagic is not responsible for payments sent to incorrect accounts where the payment was made using details you provided.
11. Banking and Payout Providers
11.1 You must provide accurate banking details for payouts and keep them up to date.
11.2 PlanTheMagic may share payout information with its bank and payment providers for the purpose of making creator payments.
11.3 PlanTheMagic’s current bank is Starling Bank Limited, trading as Starling, registered in England and Wales under company number 09092149, with its registered office at 5th Floor, London Fruit and Wool Exchange, 1 Duval Square, London, United Kingdom, E1 6PW. Starling is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and the Prudential Regulation Authority under registration number 730166.
11.4 PlanTheMagic may change its payout providers or banking arrangements from time to time.
12. Taxes and Records
12.1 You are solely responsible for all taxes, duties, filings, declarations, reporting, registrations, records, and payments arising from or connected with commissions paid to you.
12.2 PlanTheMagic does not provide tax, accounting, or financial advice.
12.3 PlanTheMagic does not require creator invoices as a standard condition of payout. Payouts are made based on PlanTheMagic’s payment and dashboard records.
12.4 PlanTheMagic does not normally require tax forms as a condition of participation unless legal, banking, compliance, or operational requirements make this necessary.
12.5 You must keep adequate records of commissions received and comply with your own tax obligations.
12.6 PlanTheMagic may make deductions, withhold payment, request information, or make reports to tax or regulatory authorities where required by law.
13. Advertising, Disclosure, and Platform Compliance
13.1 You must comply with all applicable advertising, consumer protection, influencer disclosure, platform, email marketing, privacy, and communications laws, rules, regulations, codes, and guidance that apply to your Promotional Content.
13.2 You must clearly disclose your paid referral relationship with PlanTheMagic where required by law or by the terms, policies, or rules of any platform, channel, community, or service you use.
13.3 Where disclosure is required, the disclosure must be clear, prominent, and understandable in context.
13.4 Depending on the channel and applicable rules, acceptable disclosures may include:
- (a) “I may earn a commission if you sign up through my link”;
- (b) “Ad / affiliate link”;
- (c) “Affiliate link”; or
- (d) another clear statement that accurately explains your paid referral relationship.
13.5 You must ensure that any disclosure is placed where required by law or platform rules, including near the relevant recommendation or link where required.
13.6 You must not hide a disclosure where users are unlikely to see it before engaging with the Promotional Content, where the applicable law or platform rules require earlier disclosure.
13.7 Built-in platform labels, such as “paid partnership” or “branded content”, may not be sufficient in all cases. You are responsible for ensuring that your disclosure complies with applicable law and platform rules.
13.8 PlanTheMagic may request edits, corrections, takedowns, or screenshots of Promotional Content.
13.9 PlanTheMagic may monitor your public Promotional Content for compliance with these Terms.
13.10 Failure to disclose properly may result in commission holds, commission reversals, suspension, or termination.
14. Permitted Promotional Channels
14.1 Subject to these Terms, you may promote PlanTheMagic through social media, YouTube, TikTok, Instagram, Facebook groups, blogs, newsletters, podcasts, private communities, Discord, WhatsApp, Reddit, Pinterest, and similar channels.
14.2 You are responsible for ensuring that your use of any channel complies with that channel’s rules and all applicable laws.
14.3 You must not use email campaigns, SMS campaigns, or browser extensions to promote PlanTheMagic unless PlanTheMagic gives prior written approval.
14.4 Approval for one channel, campaign, or method does not imply approval for any other channel, campaign, or method.
15. Prohibited Promotional Methods
15.1 You must not:
- (a) use spam, unsolicited email, unsolicited SMS, unsolicited direct messages, or unlawful electronic marketing;
- (b) use misleading subject lines, misleading preview text, or deceptive calls to action;
- (c) use bots, fake accounts, automated traffic, forced clicks, click injection, cookie stuffing, hidden iframes, malware, adware, spyware, browser extensions, pop-ups, auto-redirects, or similar techniques;
- (d) generate or encourage fake, duplicate, low-quality, or non-genuine signups;
- (e) make fake reviews, fake testimonials, or misleading endorsements;
- (f) use clickbait or misleading incentives;
- (g) misrepresent PlanTheMagic’s features, pricing, refund policy, subscription terms, trial terms, availability, or relationship with any third party;
- (h) make unsupported claims about savings, booking success, Disney availability, restaurant availability, AI accuracy, refunds, or guaranteed trip outcomes;
- (i) compare PlanTheMagic unfairly or misleadingly with competitors;
- (j) use coupon abuse or discount abuse;
- (k) claim that a discount, coupon, deal, or offer exists when it does not;
- (l) publish fake, expired, unauthorised, or misleading discount codes;
- (m) imply that you are PlanTheMagic staff, an official PlanTheMagic account, authorised PlanTheMagic support, or authorised to bind PlanTheMagic;
- (n) imply that PlanTheMagic is affiliated with, endorsed by, sponsored by, or approved by Disney or any Disney-affiliated entity;
- (o) use Promotional Content that is unlawful, defamatory, discriminatory, obscene, harassing, threatening, harmful, or infringing;
- (p) promote PlanTheMagic in a way that targets children;
- (q) promote PlanTheMagic through illegal, deceptive, or exploitative methods; or
- (r) do anything that could reasonably damage PlanTheMagic, its customers, its reputation, the Programme, or customer trust.
15.2 You must not bid on, purchase, target, or use Protected Brand Terms in paid search advertising.
15.3 Protected Brand Term restrictions include bidding on or targeting “PlanTheMagic”, “Plan The Magic”, “planthemagic.net”, misspellings, domain variants, and confusingly similar terms.
15.4 You must not use PlanTheMagic, Plan The Magic, planthemagic.net, or confusingly similar terms in domain names, social handles, page names, group names, ad account names, email sender names, app names, browser extension names, or similar identifiers without PlanTheMagic’s prior written approval.
16. Incentives, Bonuses, and Offers
16.1 You may offer bonuses or incentives to users who sign up through your Creator Referral Link, such as planning templates, personal advice, prize draws, cashback, gift cards, or refunding part of your commission, provided that you comply with these Terms and all applicable laws and platform rules.
16.2 Any incentive, bonus, prize draw, cashback, gift card, reward, or similar offer is your sole responsibility.
16.3 You must not describe any creator-provided incentive as a PlanTheMagic offer unless PlanTheMagic has approved it in writing.
16.4 You are responsible for clearly explaining any eligibility rules, limitations, timing, and conditions that apply to your own incentives.
16.5 PlanTheMagic is not responsible for funding, administering, honouring, or resolving disputes about creator-provided incentives.
16.6 Incentives must not be misleading, unlawful, coercive, spam-based, or designed to create fake or low-quality signups.
17. PlanTheMagic Brand Assets and Product Content
17.1 During your participation in the Programme, PlanTheMagic grants you a limited, revocable, non-exclusive, non-transferable licence to use the PlanTheMagic name, logos, screenshots, product images, product copy, and similar materials solely for lawful, accurate, non-misleading promotion of PlanTheMagic in accordance with these Terms.
17.2 You may create your own screenshots, walkthroughs, tutorials, reviews, and demonstrations of PlanTheMagic, provided that they are accurate, lawful, non-misleading, and comply with these Terms.
17.3 You must not alter PlanTheMagic brand assets in a way that is misleading, damaging, unlawful, or inconsistent with PlanTheMagic’s reasonable instructions.
17.4 You must not imply that PlanTheMagic has approved, sponsored, reviewed, or controlled your Promotional Content unless PlanTheMagic has expressly stated this in writing.
17.5 PlanTheMagic may request that you stop using, remove, correct, or update any PlanTheMagic name, logo, screenshot, product image, product copy, link, code, or Promotional Content.
17.6 You must comply with any reasonable request under clause 17.5 promptly.
18. Creator Content and Licence to PlanTheMagic
18.1 You retain ownership of your Promotional Content.
18.2 By publishing public Promotional Content that mentions, tags, links to, reviews, demonstrates, or promotes PlanTheMagic, you grant PlanTheMagic a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, quote, excerpt, screenshot, embed, repost, share, store, and otherwise use that content for:
- (a) marketing;
- (b) promotional activity;
- (c) creator directories;
- (d) internal review;
- (e) compliance monitoring;
- (f) support;
- (g) dispute handling; and
- (h) enforcement of these Terms.
18.3 The licence in clause 18.2 includes permission to use your name, creator name, social handle, logo, profile image, channel name, website name, and publicly available profile information in connection with the Programme.
18.4 The licence in this clause applies automatically to public PlanTheMagic-related Promotional Content and does not require separate permission.
18.5 You confirm that your Promotional Content is lawful, accurate, original or properly licensed, non-infringing, and compliant with applicable platform rules.
18.6 You must remove or stop using PlanTheMagic-related Promotional Content, links, codes, brand assets, or materials if PlanTheMagic reasonably asks you to do so.
19. Referred Customer Data
19.1 Creators do not receive personal data about referred customers from PlanTheMagic.
19.2 Creator Dashboard information may include aggregated or attribution-related statistics but will not identify referred customers by name, email address, or other direct personal details.
19.3 You must not try to identify, contact, track, profile, interfere with, or obtain information about referred customers unless the customer independently and knowingly shared that information with you outside PlanTheMagic.
19.4 You must not represent to customers that you can access their PlanTheMagic account, billing information, support records, trip data, or subscription data.
20. Data Protection and Privacy
20.1 PlanTheMagic processes creator personal data in accordance with its Privacy Policy.
20.2 Creator personal data may include your name, email address, country, social handles, website, payout details, referral statistics, communications, and audit logs.
20.3 Payout data may be shared with PlanTheMagic’s bank and payment providers, including Starling, for the purpose of making payments.
20.4 If you collect personal data through your own Promotional Content, incentives, newsletters, communities, or campaigns, you are responsible for complying with applicable privacy and data protection laws in relation to that data.
20.5 You must not provide PlanTheMagic with third-party personal data unless you have a lawful basis to do so.
21. Programme Integrity and Adjustments
21.1 PlanTheMagic may void, hold, reverse, decline, or adjust commissions linked to:
- (a) refunds;
- (b) chargebacks;
- (c) cancellations;
- (d) payment failures;
- (e) duplicate accounts;
- (f) returning customers;
- (g) previously deleted accounts;
- (h) trial re-use;
- (i) self-referrals that are not genuine New Customer referrals;
- (j) bot traffic;
- (k) fake accounts;
- (l) forced clicks;
- (m) cookie stuffing;
- (n) click injection;
- (o) tracking errors;
- (p) dashboard errors;
- (q) suspicious activity;
- (r) customer Terms breaches;
- (s) creator Terms breaches; or
- (t) any activity PlanTheMagic reasonably considers inconsistent with the purpose of the Programme.
21.2 PlanTheMagic may hold commissions and payouts while it investigates any suspected issue.
21.3 PlanTheMagic’s records will be used to determine referral attribution, commission status, qualification, payout eligibility, and adjustments, except where there is clear evidence of error.
22. Suspension, Termination, and Inactive Profiles
22.1 Either you or PlanTheMagic may terminate your participation in the Programme at any time.
22.2 PlanTheMagic may suspend, pause, restrict, or terminate your creator profile immediately if it reasonably believes that:
- (a) you have breached these Terms;
- (b) you have used prohibited promotional methods;
- (c) you have failed to make required disclosures;
- (d) you have misrepresented PlanTheMagic;
- (e) you have engaged in fraud, misuse, bot traffic, fake accounts, spam, cookie stuffing, click injection, or similar activity;
- (f) your Promotional Content is unlawful, misleading, harmful, or reputationally damaging;
- (g) your payout details are invalid or incomplete;
- (h) your creator profile is inactive; or
- (i) suspension or termination is needed to protect PlanTheMagic, the Programme, customers, or third parties.
22.3 PlanTheMagic may disable your Creator Referral Link immediately on suspension or termination.
22.4 If your participation is terminated and the termination is not due to your breach of these Terms, you will remain eligible to be paid valid Qualified Commissions earned before termination, provided that:
- (a) the commissions have qualified;
- (b) the applicable minimum payout threshold has been met;
- (c) no hold, adjustment, reversal, or disqualifying event applies; and
- (d) you have provided valid payout details.
22.5 If your participation is terminated because of breach, fraud, misuse, non-disclosure, prohibited promotion, suspicious activity, or other misconduct, your unpaid balance, including pending and payable amounts, may be forfeited to the maximum extent permitted by law.
22.6 Pending commissions may be forfeited where termination is for fraud, misuse, non-disclosure, prohibited promotion, or breach of these Terms.
22.7 PlanTheMagic may close inactive creator profiles after 12 months of inactivity or missing payout details.
22.8 After suspension or termination, you must stop using PlanTheMagic links, referral codes, brand assets, and promotional materials if PlanTheMagic asks you to do so.
22.9 Any clauses that by their nature should continue after termination will continue, including clauses relating to taxes, repayment, intellectual property, data protection, prohibited conduct, indemnity, liability, governing law, and disputes.
23. Programme Changes
23.1 PlanTheMagic may change the Programme at any time.
23.2 Changes may include changes to:
- (a) commission rates;
- (b) payout thresholds;
- (c) qualification periods;
- (d) attribution methods;
- (e) attribution windows;
- (f) eligible countries;
- (g) approved promotional methods;
- (h) prohibited promotional methods;
- (i) dashboard features;
- (j) payout methods;
- (k) currencies;
- (l) eligibility criteria; and
- (m) Programme availability.
23.3 Changes take effect immediately when posted, shown in the Creator Dashboard, or otherwise communicated, unless PlanTheMagic states a later effective date.
23.4 Continued use of your Creator Referral Link after a change means you accept the updated Terms or Programme rules.
23.5 Changes may apply to pending commissions, except that commission rate reductions will not reduce already recorded Pending Commissions unless the commission is otherwise subject to correction, adjustment, hold, reversal, forfeiture, or disqualification under these Terms.
23.6 PlanTheMagic may pause, restrict, or end the Programme entirely at any time.
24. Creator Warranties
24.1 You warrant that:
- (a) all information you provide to PlanTheMagic is accurate, complete, and current;
- (b) you have the legal right and authority to enter into these Terms;
- (c) your Promotional Content is lawful, accurate, original or properly licensed, non-infringing, and compliant with applicable platform rules;
- (d) your Promotional Content will not be misleading, deceptive, defamatory, discriminatory, obscene, harmful, or unlawful;
- (e) you will comply with all applicable advertising, consumer protection, privacy, data protection, platform, email marketing, SMS marketing, and communications laws;
- (f) you will not use prohibited promotional methods;
- (g) you will not misrepresent your relationship with PlanTheMagic;
- (h) you will not imply that PlanTheMagic is affiliated with, endorsed by, sponsored by, or approved by Disney; and
- (i) you will comply with these Terms at all times.
25. Indemnity
25.1 You agree to indemnify PlanTheMagic against any losses, liabilities, damages, costs, claims, expenses, penalties, fines, and legal fees arising out of or connected with:
- (a) your breach of these Terms;
- (b) your Promotional Content;
- (c) your failure to comply with advertising, consumer protection, privacy, platform, email, SMS, tax, or other applicable laws;
- (d) misleading claims, unsupported claims, or unlawful promotions made by you;
- (e) your incentives, bonuses, cashback, prize draws, gift cards, or other creator-provided offers;
- (f) your misuse of PlanTheMagic brand assets;
- (g) your tax failures or reporting failures;
- (h) fraud, bot traffic, fake accounts, cookie stuffing, click injection, or similar misconduct; or
- (i) any claim that your content infringes another person’s rights.
26. Relationship Between the Parties
26.1 Participation in the Programme does not create an employment, worker, agency, partnership, joint venture, franchise, fiduciary, or representative relationship between you and PlanTheMagic.
26.2 You have no authority to bind PlanTheMagic, make commitments on PlanTheMagic’s behalf, provide customer support on PlanTheMagic’s behalf, or represent yourself as PlanTheMagic staff.
26.3 You are responsible for your own costs, equipment, channels, content, tax, insurance, and business arrangements.
27. Liability
27.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
27.2 Nothing in these Terms excludes or limits liability for:
- (a) death or personal injury caused by negligence;
- (b) fraud or fraudulent misrepresentation;
- (c) deliberate misconduct; or
- (d) any other liability that cannot lawfully be excluded or limited.
27.3 To the maximum extent permitted by law, PlanTheMagic excludes all implied warranties, conditions, representations, and guarantees relating to the Programme.
27.4 The Programme is provided on an “as available” basis. PlanTheMagic does not guarantee that the Programme, Creator Dashboard, referral tracking, reporting, links, cookies, payouts, or creator tools will be uninterrupted, accurate, error-free, or available at all times.
27.5 To the maximum extent permitted by law, PlanTheMagic will not be liable for:
- (a) loss of profit;
- (b) loss of revenue;
- (c) loss of business;
- (d) loss of goodwill;
- (e) loss of opportunity;
- (f) loss of anticipated commission;
- (g) loss caused by tracking failure;
- (h) loss caused by dashboard error;
- (i) indirect or consequential loss; or
- (j) losses arising from suspension, termination, Programme changes, or Programme closure.
27.6 To the maximum extent permitted by law, PlanTheMagic’s total liability to you in connection with the Programme will be limited to valid unpaid commissions that have become payable to you under these Terms at the time the claim arises.
27.7 If applicable law does not permit the limitation in clause 27.6 to apply in full, PlanTheMagic’s liability will be limited to the lowest amount permitted by applicable law.
28. Governing Law and Courts
28.1 These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation, including non-contractual disputes or claims, are governed by the laws of England and Wales.
28.2 The courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms or the Programme.
29. General
29.1 These Terms, together with the Privacy Policy where applicable to data processing, form the entire agreement between you and PlanTheMagic in relation to the Programme.
29.2 You may not transfer, assign, subcontract, or delegate your rights or obligations under these Terms without PlanTheMagic’s prior written consent.
29.3 PlanTheMagic may transfer or assign its rights and obligations under these Terms as part of a business sale, restructuring, merger, acquisition, asset transfer, or corporate reorganisation.
29.4 If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.
29.5 Failure or delay by PlanTheMagic to enforce any provision of these Terms does not waive its right to enforce that provision later.
29.6 Headings are for convenience only and do not affect interpretation.
